These Terms of Service ("Terms") govern your access to and use of the website, member portal, and services provided by The Dental Vision Institute ("we," "our," or "us"). By accessing our website, creating an account, or enrolling in any of our dental or vision insurance plans, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
Acceptance of Terms
By accessing or using our website at thedentalvision.com, the member portal at portal.usdentalvision.com, or any services offered by The Dental Vision Institute, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and our Cookies Policy. These Terms constitute a legally binding agreement between you and The Dental Vision Institute.
If you are enrolling on behalf of a family member, dependent, or employee group, you represent and warrant that you have the authority to bind such individuals to these Terms.
Eligibility
To use our services and enroll in an insurance plan, you must meet the following eligibility requirements:
- You must be at least 18 years of age or the age of majority in your state of residence, whichever is greater.
- You must be a legal resident of the United States.
- You must have the legal capacity to enter into a binding contract.
- Dependents under the age of 18 may be enrolled under a parent or legal guardian's plan, but the parent or guardian is responsible for all obligations under these Terms.
We reserve the right to refuse service, terminate accounts, or cancel enrollment if we determine that any eligibility requirements are not met.
Account Registration
To access certain features of our services, including the member portal, you must create an account. When registering, you agree to:
- Provide Accurate Information. You must provide truthful, complete, and current information during the registration process and keep your account information updated at all times. Providing false or misleading information may result in the denial of claims or termination of your coverage.
- Maintain Account Security. You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
- One Account Per Person. Each individual may maintain only one account. You may not create multiple accounts or share your account credentials with others.
Insurance Coverage
All dental and vision insurance coverage provided through The Dental Vision Institute is subject to the specific terms, conditions, limitations, and exclusions set forth in your individual plan documents. Please review your plan documents carefully. Important considerations include:
- Plan Terms. Your specific coverage, benefits, copayments, coinsurance, deductibles, and annual maximums are governed by the terms of your selected plan. In the event of a conflict between these Terms of Service and your plan documents, the plan documents shall control with respect to coverage matters.
- Waiting Periods. Certain services and procedures may be subject to waiting periods before coverage becomes effective. Waiting periods vary by plan and are detailed in your plan documents. Preventive care services may be covered immediately, while major procedures may require waiting periods of up to 12 months.
- Exclusions and Limitations. Not all dental and vision services are covered under every plan. Pre-existing conditions, cosmetic procedures, experimental treatments, and certain other services may be excluded from coverage. Refer to your plan's Schedule of Benefits for a complete list of exclusions and limitations.
- No Guarantee of Benefits. Enrollment in a plan does not guarantee that any specific claim will be approved or paid. All claims are subject to review and adjudication in accordance with the terms of your plan and applicable law.
- Provider Network. Benefits may vary depending on whether you receive services from an in-network or out-of-network provider. Using in-network providers will generally result in lower out-of-pocket costs.
Payments and Billing
By enrolling in an insurance plan, you agree to the following payment terms:
- Monthly Premiums. You agree to pay the monthly premium amount associated with your selected plan. Premium amounts are specified during the enrollment process and in your plan documents. We reserve the right to adjust premium amounts upon renewal with prior notice as required by applicable law.
- Automatic Payments. By providing your payment information, you authorize us to charge your designated payment method on a recurring monthly basis for your premium and any applicable fees. It is your responsibility to ensure your payment method remains valid and has sufficient funds.
- Late Payments. If a premium payment is not received by the due date, your coverage may be at risk. We will make reasonable efforts to notify you of a missed payment, but failure to receive notice does not relieve you of your payment obligation.
- Grace Periods. In accordance with applicable Florida insurance regulations, a grace period of 31 days will be provided for the payment of each premium after the first. During the grace period, your coverage will remain in effect. If payment is not received by the end of the grace period, your coverage may be terminated retroactively to the last date for which premium was paid.
Cancellation and Refunds
The following terms govern cancellation of your insurance plan:
- Cancellation by Member. You may cancel your plan at any time by contacting our member services team or through the member portal. Cancellation will take effect at the end of your current billing cycle. You will continue to have coverage through the last day of the period for which you have paid.
- No Partial Refunds. We do not provide refunds for partial billing periods. If you cancel mid-cycle, your coverage will remain active through the end of that billing cycle, and no pro-rated refund will be issued.
- Cancellation by Us. We reserve the right to cancel your plan for nonpayment of premiums, fraud, material misrepresentation on your application, or other grounds permitted by applicable law. We will provide written notice of cancellation as required by Florida law.
- Reinstatement. If your plan is terminated due to nonpayment, you may apply for reinstatement subject to our reinstatement policies and any applicable waiting periods.
Member Portal
The Dental Vision Institute provides an online member portal at portal.usdentalvision.com for plan management and account services. The following terms apply to your use of the portal:
- Account Security. You are solely responsible for all activities that occur under your portal account. You must use a strong, unique password and must not share your login credentials with any third party.
- Permitted Use. The member portal is provided solely for the purpose of managing your insurance plan, viewing benefits, submitting claims, making payments, and accessing plan documents. Any other use, including but not limited to scraping, data mining, or automated access, is strictly prohibited.
- Availability. We strive to maintain the portal's availability at all times, but we do not guarantee uninterrupted access. The portal may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Intellectual Property
All content, materials, and intellectual property available on our website and member portal, including but not limited to text, graphics, logos, images, software, trademarks, service marks, and trade names, are the exclusive property of The Dental Vision Institute or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our website and portal for personal, non-commercial purposes in connection with your insurance plan. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from our website without our prior written consent.
Limitation of Liability
To the fullest extent permitted by applicable law, The Dental Vision Institute, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use our website, portal, or services.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total amount of premiums you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim. This limitation of liability applies regardless of the legal theory on which the claim is based, whether in contract, tort, strict liability, or otherwise.
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded or limited.
Governing Law
These Terms of Service and any disputes arising out of or related to these Terms or your use of our services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you hereby consent to the personal jurisdiction and venue of such courts.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.
Changes to Terms
We reserve the right to modify or update these Terms of Service at any time at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you by email or through a prominent notice on our website. Your continued use of our services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of our services.
